brands list in mega menu showing empty brands

in menu->appearance I added custom link “brands” and set it to full width. I connected it with block which I created in “blocks”. In the block I added container and placed “brands” and set it to “hide empty brands”, but somehow even if I open new page in incognito mode, some of the brands which are empty (no products available in store) are still showing in the mega menu. Do you have any idea how to solve this?

Thanks for details.
The Brands widget in menu is working correctly, Empty means NO products belong to the attributes, it doesn’t mean Out of stock products.

Ok, is there any chance that out of stock products of a brand will not show in the widget? this would be very nice user experience function

Unfortunately, there is no such an option right now.
