Layered navigation filter button visible when no filters are selected

Hi,
I’ve set the layered navigation only on 1 category, but the filter button is visible on all categories. That doesn’t make sense, because there are no filter to use when you click the button.
How can I hide the filter button on categories when no filters are selected? Or is this a bug in the theme?
To reproduce:
– click check link in private content
– notice the filter button and click it
– notice that there are no filters
– solution should be to hide the button, that should be the case automatically

Then check back. If the issue still occurs then provide the login details of the website.
